1. Acceptance of Terms

By accessing and using JobMatch ("the Platform", "we", "us", "our"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

JobMatch is a job matching platform that connects job seekers ("Candidates") with employers ("Companies") based on personality traits, work habits, and core values compatibility. We provide a platform for matching but are not a party to any employment relationship.

3. User Accounts

3.1 Registration

To use certain features of the Platform, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your information to keep it accurate, current, and complete
  • Maintain the security of your password and identification
  • Accept all responsibility for activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

3.2 Account Types

You may register as either a Candidate or a Company. You may not maintain multiple accounts or register as both types simultaneously without our express written permission.

4. User Responsibilities

4.1 Candidate Responsibilities

Candidates agree to:

  • Provide truthful and accurate information in their profile
  • Respect the privacy and rights of Companies
  • Not engage in fraudulent, deceptive, or illegal activities
  • Not share account credentials with others

4.2 Company Responsibilities

Companies agree to:

  • Provide accurate information about their company, culture, and job opportunities
  • Comply with all applicable employment laws and regulations
  • Not discriminate against candidates based on protected characteristics
  • Respect candidate privacy and data protection rights
  • Honor any commitments made through the Platform

5. Matching and Communication

Our matching algorithm is provided for informational purposes only. We do not guarantee matches, employment, or any specific outcomes. All interactions between Candidates and Companies are at their own discretion and risk.

Users are responsible for their communications and interactions with other users. We are not responsible for the conduct of any user.

6. Intellectual Property

6.1 Platform Content

All content on the Platform, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, and software, is the property of JobMatch or its content suppliers and is protected by international copyright laws.

6.2 User Content

By submitting content to the Platform, you grant JobMatch a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute such content for the purpose of operating and promoting the Platform.

You retain ownership of your content but grant us the right to use it as described above.

7. Prohibited Activities

You agree not to:

  • Use the Platform for any illegal purpose or in violation of any laws
  • Post false, misleading, or fraudulent information
  • Harass, abuse, or harm other users
  • Impersonate any person or entity
  • Collect or store personal data about other users without their consent
  • Use automated systems to access the Platform without authorization
  • Interfere with or disrupt the Platform or servers
  • Attempt to gain unauthorized access to any portion of the Platform
  • Reverse engineer, decompile, or disassemble any part of the Platform

8. Payment Terms

8.1 Subscription Fees

Companies may be required to pay subscription fees for certain features. All fees are non-refundable unless otherwise stated. Fees are subject to change with 30 days' notice.

8.2 Payment Processing

Payments are processed through third-party payment processors. We are not responsible for any issues arising from payment processing.

9. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Platform will be uninterrupted, secure, or error-free. We do not guarantee the accuracy, completeness, or usefulness of any information on the Platform.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOBMATCH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claims arising from or related to the Platform shall not exceed the amount you paid to us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless JobMatch, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Platform, violation of these Terms, or infringement of any rights of another.

12. Termination

12.1 By You

You may terminate your account at any time by contacting us or using the account deletion feature in your settings.

12.2 By Us

We may suspend or terminate your account immediately, without prior notice, if you violate these Terms or engage in any fraudulent, illegal, or harmful activity.

12.3 Effect of Termination

Upon termination, your right to use the Platform will cease immediately. We may delete your account and data in accordance with our Privacy Policy.

13. Dispute Resolution

Any disputes arising from or relating to these Terms or the Platform shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration association, except where prohibited by law.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Myanmar, without regard to its conflict of law provisions. For international users, applicable local laws may also apply.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Platform. Your continued use of the Platform after such modifications constitutes acceptance of the updated Terms.
